The piece opens by giving the Supreme Court its due. When Jair Bolsonaro lost his bid for re-election in 2022 and plotted a coup rather than accept the result, it was Brazil’s Supreme Court that held him to account. The justices proceeded calmly in the face of constant threats — including from Donald Trump — and in September 2025 handed the populist former president a 27-year sentence. Most Brazilians cheered: their young democracy had been saved.

Note the rhetorical function of that opening. A leader that is about to attack an institution first establishes that it is not attacking in bad faith: the court really did do the hard thing, at real risk. Only once that credit is banked does the argument turn.

With a general election approaching on October 4th, the turn arrives in a single sentence: democracy’s defenders have become a threat. The Supreme Court sits at the centre of an ugly, ever-expanding corruption scandal, and in the middle of it is the very justice who oversaw Bolsonaro’s prosecution, Alexandre de Moraes.

The photograph at the top of the original makes the point without a word of commentary: a supporter of Flávio Bolsonaro holds a placard of Justice Moraes captioned “Perdeu, mané” — “You lost, fool” — the phrase Moraes himself once threw at a heckling bolsonarista, now thrown back at him.

Even in the Bolsonaro case, the leader argues, Moraes made several questionable decisions. He took down social-media accounts — especially those of bolsonaristas — which he claimed threatened the Supreme Court. The “fake-news inquiry”, as the Brazilian press dubbed it, continues to this day and remains confidential, so it is impossible to know how many accounts Moraes has censored, or why.

Abuse of the instrument has since become more common. Moraes has used the probe to shield himself and his colleagues from allegations of impropriety — including by going after tax officials and journalists’ sources. The tool built to protect the court from a coup is now being pointed at the people investigating the court.

There was a structural problem too. Moraes was compromised in the case by holding three roles at once: Bolsonaro’s underlings had planned to assassinate him, yet he oversaw the collection of evidence against them and then delivered a guilty ruling. Victim, prosecutor and judge in the same proceeding.

At the time, much of Brazilian society brushed these concerns aside in the face of the greater threat. That phrase — in the face of the greater threat — is the hinge of the whole argument: it concedes that the reasoning was understandable, while implying that the bill for it is now falling due.

Last November Brazil’s central bank shut down a lender, Banco Master, run by a playboy called Daniel Vorcaro. All the signs are that Vorcaro’s bank was a Ponzi scheme with an influence-peddling operation attached. He invited politicians to lavish parties with sex-workers, and feted several members of the Supreme Court — Moraes among them.

Read the sentence “a Ponzi scheme with an influence-peddling operation attached” twice. It is doing two things at once: naming the financial crime, and then treating the political corruption as a bolt-on accessory — which is exactly how contemptuous the writer wants you to feel.

Since the bank’s collapse, investigators have found worrying links between the two men. Moraes’s wife, a lawyer, had been hired by Vorcaro to represent the bank on an unusually vague and expensive contract. On September 1st the federal police published a report revealing a second, draft contract that would have given Ms Moraes’s law firm the right to use a private jet and a helicopter owned by Vorcaro.

Moraes apparently also gave advice to Vorcaro using a WhatsApp feature in which messages disappear after they are read. The frequency of these messages increased shortly before Vorcaro was arrested trying to flee the country, raising fears about what kind of advice the justice was giving the fraudster. Moraes denies any wrongdoing.

That a powerful Supreme Court justice has any links at all with Brazil’s biggest fraudster is disappointing. Worse, the leader says, is Moraes’s response. When the connections first emerged, the court’s upright president, Edson Fachin, proposed adopting an ethics code that would, among other things, require judges to account for outside earnings. Moraes scoffed at the idea.

Then, on September 3rd, Moraes requested that a fellow justice, André Mendonça, who is leading the Banco Master case, be criminally prosecuted under the “fake-news inquiry”. He accused Mendonça of abusing his authority by publishing messages between Moraes and Vorcaro, and said the judge — a Bolsonaro appointee — was politically motivated and deliberately selective. Fachin threw out the request and said the “fake-news inquiry” should be closed.

And yet, the leader concedes, Moraes may have a point. Mendonça has not published evidence against the other justices who also had dealings with Vorcaro. The federal police have accused him of meddling in the collection of evidence. On September 8th he tried to suspend the head of the federal police and to bar the production of intelligence reports on judges.

The sting is in the last clause. In 2020, when Mendonça was serving as Bolsonaro’s justice minister, he oversaw the compilation of a dossier on hundreds of police officers and academics whom Bolsonaro considered enemies. The man now objecting to intelligence reports on judges once built the files himself.

Dysfunction on the bench is boosting Bolsonaro’s allies in Congress, who are promising to impeach Supreme Court justices after the election and to pardon the former president. Meanwhile Mendonça’s procedural missteps and Moraes’s brazen attempts to shield himself could between them provide the legal justification to shut down the entire Banco Master investigation.

That would not only benefit Moraes and some of his colleagues, but also dozens of politicians with links to the fraudster. One would be Flávio Bolsonaro, the eldest son of Jair and the right’s leading candidate for the presidency. Having claimed he had never met Vorcaro, Flávio was caught out in May when audio messages leaked in which he can be heard asking Vorcaro for millions of dollars.

The biggest loser would be Brazil’s democracy. Brazilians are tired of the corruption scandals that tarnish their political class every few years. They used to trust their top court, which has sent dozens of politicians to jail for graft. Now that trust is fraying.

That closing sentence is the argument in miniature. A coup attempt is a visible, datable assault that institutions can be marshalled against. Rot inside those same institutions offers nothing to defend against — and leaves citizens with no one left to appeal to.
